DACA

To be eligible for adjustment of status, the applicant must meet certain requirements, including:

  • Be physically present in the United States.
  • Have entered the country legally.
  • Be eligible for an immigrant visa.
  • Have not committed certain crimes that would make them inadmissible.

TPS

Temporary Protected Status (TPS) is granted to nationals of countries experiencing armed conflict, natural disasters, or extraordinary conditions. TPS allows individuals to live and work legally in the U.S. for the designated period and can be renewed while unsafe conditions persist in the home country. Eligible countries include El Salvador, Haiti, Honduras, Nepal, Nicaragua, Somalia, South Sudan, Syria, and Yemen. TPS applications are filed using Form I-821.
